Right of withdrawal for consumers

(Consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The cancellation period is 14 days from the day

  • on which you or a third party other than the carrier designated by you takes possession of the goods, provided that you have ordered one or more goods as part of a single order and these are or will be delivered as a single order;
  • on which you or a third party other than the carrier designated by you took possession of the last good, provided that you have ordered several goods as part of a single order and these are delivered separately;
  • on which you or a third party other than the carrier designated by you took possession of the last partial shipment or the last piece, provided that you have ordered goods that are delivered in several partial shipments or pieces;
  • in the case of a contract for the supply of digital content not supplied on a physical medium, from the date of conclusion of the contract;
  • in the case of a service contract, from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Quiltservice Ines Lichtenberg, Parkstraße 71, 01809 Heidenau, Germany, telephone: 0178 5471671, email: info@maggieandme.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the 14-day period.

You shall bear the direct costs of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Special information on services

If you have requested that the services begin during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.

The right of withdrawal expires in the case of a contract for the provision of services if we have fully provided the service and have only started to perform the service after you have expressly agreed that we may start to perform the contract before the expiry of the withdrawal period and at the same time confirmed your knowledge that by giving your consent you will lose your right of withdrawal when we start to perform the contract.

Special information on digital content

The right of withdrawal expires in the case of a contract for the supply of digital content that is not supplied on a physical data carrier if we have begun to execute the contract after you

  • have expressly agreed that we may begin executing the contract before the expiry of the withdrawal period, and
  • You have confirmed your knowledge that by giving your consent you will lose your right of withdrawal once the contract has begun to be executed.

Grounds for exclusion or expiration

The right of withdrawal does not apply to contracts

  • for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
